Please read these terms and conditions of use carefully before accessing, using or obtaining any materials, information, products or services. By accessing the Chronos Heritage website or any other feature or other platform (collectively “Our Website”) operated by Chronos Heritage (“us”, “we”, or “our”), you agree to be bound by these terms and conditions (“Terms”) and our Privacy Policy.

 

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

 

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

 

Purchases and Payment

 

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, your family members’ names, and any relevant dates or places.

 

Certain orders, at our sole discretion, can be canceled if the products ordered have incorrect prices due to various errors or if the client does not provide the correct payment.

 

We will not provide research results until payment is made in full.

Modifications

 

Chronos Heritage has the right, at its sole discretion, to modify this Agreement, as well as the Website, Content, and the Services, at any time. Changes will be posted on the pertinent Website(s) and/or sent via email, and by changing the date of last revision on this Agreement. If you already have a genealogy and/or travel package in process, you may refer to the previous terms of use. All future purchases will fall under the new terms.

 

We likewise reserve the right to refuse service to any potential client at our sole discretion.

 

Your Use of the Website, Content, and Materials

 

The Website contains text, software, scripts, graphics, information, data, pictures, sounds, music, videos, interactive features, user generated information, editorial and other content accessible by Users (the “Content”). All Content is owned, licensed to and/or copyrighted by Chronos Heritage and may be used only in accordance with this Agreement. The Website is also protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international conventions, and other copyright laws. The trademarks, service marks and logos contained in the Websites are owned by or licensed to Chronos Heritage. Chronos Heritage and its licensors retain title, ownership and all other rights and interests in and to all information and Content on the Websites. All Content on the Website, whether protected by copyright, contract rights, or both, is provided to you AS IS for your information and use only as permitted through the functionality of the Website. We attempt to ensure that all Content on the Websites is complete and accurate. Despite our efforts, the Content may occasionally be inaccurate or incomplete and we make no representation that the Content on the Websites is complete, accurate, reliable or error-free.

You may access the Websites only personally with an individual browser and use the Content only for personal family history research, and download Content only as relevant to that research or where expressly permitted by Chronos Heritage. Resale of a work is prohibited.

Chronos Heritage does not claim an exclusive right to images already in the public domain that it has converted into a digital format. However, the Website contains images or documents that are protected by copyrights or that, even if in the public domain, are subject to restrictions on reuse. By agreeing to these Terms and Conditions, you agree to not reuse these images or documents except that you may reuse public domain images so long as you only use small portions of the images or documents for personal use. If you republish public domain images, you agree to credit Chronos Heritage as the source of the digital image, unless additional specific restrictions apply. If you wish to republish more than a small portion of the images or documents from the Websites, you agree to obtain prior written permission from us.

 

By using the Website, you agree to comply with all applicable laws and refrain from infringing any third-party rights or interests (for example, privacy and intellectual property rights).

 

We allow clients to use reports, documents, and data that we’ve provided to them, including the use of these things in family history books and on the Internet, provided that excerpts from our reports are not altered and accurately portray our written conclusions. When information that we found is used, please include us as a source or as the author of the information using the following citation: “Chronos Heritage Services, https://chronosheritage.com.” Any use of reports, documents, and data which we’ve provided you other than as specifically permitted herein or without our prior written consent is expressly prohibited.

Warranty and Limitation of Liabilities

 

The amount payable to us is based upon the value of the services we provide and is not related to the various uses to which you may put our research nor are results guaranteed. For example, if you are using our research for the purpose of establishing genealogy for purposes of qualifying for grants, scholarships or other benefits, or are seeking to locate potential beneficiaries of a decedent or gain dual citizenship status, the cost of our services has not been determined with reference to such uses, but has been determined solely by reference to the amount of time we spend performing our research services. We are not an insurer of any risk relating to the uses to which you may put our research.

 

To the fullest extent permitted by law, you acknowledge and agree that we have not made and do not make any representations or warranties (whether by statute, common law, custom, usage or otherwise) regarding the accuracy or completeness of our search results, and specifically disclaim any and all implied warranties of merchantability or fitness for a particular purpose. In no event shall we be liable to you or any other person for any indirect, incidental, special, consequential, or punitive damages or claims for loss of business or profits, damage to reputation or otherwise under contract, tort (including negligence) or other legal or equitable theory, regardless of the cause of action and even if we have been advised of the possibility of such potential loss or damage.

 

To the fullest extent permitted by law, you agree that it is impractical and extremely difficult to fix the actual damages, if any, which may proximately result from failure on our part to perform any of our obligations, and that if we should be found liable for loss, damage, or injury due to our services in any respect, our liability shall be limited to the amount you pay for our services, regardless of whether such loss, damage or injury results directly or indirectly from our negligence or active, passive, intentional or other act.

 

We allow others (e.g., family history societies, journalists) to reproduce content published in our blog posts as long as they comply with the following policies:

• Printed materials and presentations: Others may reproduce content from our blog posts in printed materials and presentations as long as they provide credit to Chronos Heritage Services by including a link to https://chronosheritage.com (or a direct link to the original blog post) in their publication or presentation.

• Internet and electronic communications: Others may reproduce content from our blog posts on the Internet or in electronic communications as long as they include a link to our original blog post. Reproductions should constitute (1) select quotations and/or readers’ original summaries with (2) a link to the post rather than extensive reproductions of the post’s contents (i.e., more than two paragraphs).

 

We reserve the right to talk about our research triumphs and challenges in our blog and in other online, print, and audio communications. This can include talking about locations, records (including images or partial images of records), and other information involving a genealogy research problem, but we change names and avoid using identifying details unless we have prior permission. You waive any right to royalties or other compensation which may arise or which may be related to the use of information as described above. You also hereby hold harmless and release and forever discharge Chronos Heritage from all claims, demands, and causes of action which you or any other person acting on your behalf or on behalf of your estate have or may have. For clients who prefer that their research never be discussed publicly in any way, you may contact us. Research reports are also shared internally for quality control and training.

Refund Policy

 

If you are not 100% satisfied with your purchase, you can cancel the purchase and get a full refund or exchange the service for another one, be it similar or not.

 

You can cancel a purchase for up to 5 days from the date you purchased it for a full refund. After 5 days, if there is a dispute, decisions will be made on a case by case basis, with third party arbitration if necessary.

How your money is refunded depends on how you made the original payment.

• If you paid with a credit card, the money is refunded to your card. If the card you paid with is closed or invalid, the money will still be refunded to your credit card account.

• If you paid with your bank or PayPal account balance, the money is refunded to your PayPal account. After you have received the refund, you can withdraw money from your PayPal balance to your bank account.

• If you paid using a credit card and your PayPal account balance, the amount paid by credit card is refunded to your card. The remaining amount is refunded to your PayPal account.

• If you paid using PayPal Credit, the amount is refunded to your PayPal Credit account.

• If you paid with a debit card, the amount is refunded to your debit card. If the refund cannot be applied to your debit card, it will be applied to your PayPal balance.

 

Refunds to credit or debit cards can take up to 30 days depending on the card company involved.

 

Privacy Policy

• Location Information. We may also collect geolocation data pertaining to your mobile device. This data may consist of precise latitude/longitude coordinates and may be linked to a device ID. We may use this location data to send you relevant information and offers from Chronos Heritage.

 

This information allows us to provide you with the service you have purchased and will never be given or sold to any third parties without explicit permission from you. Chronos Heritage stores all personal information in private files that are shared with no third parties.

If you provide permission for Chronos Heritage to use your personal information for any other reason, we may use information that you provided us in marketing materials or on our website. This permission must be explicitly given in writing and may be revoked at any time. If at any time you choose to have your information removed from any marketing materials or pages on our website, please contact us and we will have it removed.  

 

www.chronosheritage.com uses Google Analytics to collect visitor data and analyze traffic on our site. This information helps us understand customer interests and helps us improve our website. When you visit our site, the pages that you look at, and a short text file called a cookie, are downloaded to your computer. A cookie is used to store small amounts of information. This information is collected for traffic analysis only. The cookie does not contain personal details. Depending on the browser that you use, you can set your preferences to block/ refuse cookies, and/ or notify you before they are placed. Please visit support.google.com for their privacy policy.
